Section 1. Short title and Commencement

Chapter-I - Preliminary

CHAPTER I

PRELIMINARY

1. Short title and Commencement.- (1) This Act may be called The Uttaranchal (Emoluments and Pension of the State Assembly Members, Ministers and Officers) (Amendment) Act, 2005.

(2) It shall come into force with effect from April 01, 2004.

Chapter-II - Amendment in Section 3 of the Uttar Pradesh State Legislature Act No. 23 of 1980

CHAPTER II

AMENDMENT IN SECTION 3 OF THE UTTAR PRADESH STATE LEGISLATURE ACT NO. 23 OF 1980

2. In section 3 of the Uttar Pradesh State Legislature (Members Emoluments and Pension) Act, 1980, hereinafter referred to in this Chapter as the principal Act in sub-section (1) for the words Two thousand rupees the words ‘Three thousand rupees’ shall be substituted.

Section 3. Amendment to Section 4

3. Amendment to Section 4.- In section 4 of the principal Act for the words ‘Five thousand rupees’ the words ‘Seven thousand five hundred rupees’ shall be-substituted.

Section 4. Amendment of Section 5

4. Amendment of Section 5.- In sub-section (2) of section 5 of the principal Act-

"For the words ‘Ten thousand rupees’ the words ‘Twenty thousand rupees’ shall be substituted."

Section 5. Amendment of Section 14

5. Amendment of Section 14.- In section 14 of the principal Act, in clause (d), in the second proviso for the words ‘Two members’ the words ‘Five members’ shall be substituted.

Section 6. Amendment of Section 15

6. Amendment of Section 15.- In section 15 of the principal Act-

(a) In sub-section (1) for the words ‘Two hundred fifty rupees’ the words ‘Three hundred rupees’ shall be substituted;

(b) In sub-section (2) for the words ‘two hundred rupees’ the words ‘two hundred fifty rupees’ shall be substituted;

(c) In sub-section (3) for the words ‘Two hundred rupees’ the words ‘Two hundred fifty rupees’ shall be substituted.

Section 7. Amendment of Section 15-A

7. Amendment of Section 15-A.- In section 15-A of the principal Act, for the words ‘One thousand rupees’ the words ‘Two thousand five hundred rupees’ shall be substituted.

Section 8. Amendment of Section 18-A

8. Amendment of Section 18-A.- In section 18-A of the principal Act, in clause (a) for the words ‘One thousand rupees’ the words ‘Two thousand rupees’ shall be substituted.

Section 9. Amendment of Section 24

9. Amendment of Section 24.- Infection 24 of the principal Act-

(a) In sub-section (1) for the words ‘One thousand five hundred rupees’ the words ‘Two thousand rupees’ shall be substituted;

(b) In the proviso for the words ‘Two hundred rupees’ the words ‘Two hundred fifty rupees’ shall be substituted;

(c) After the first proviso the following proviso shall be inserted, namely:-

"Provided further that in the event of dissolution of Assembly, the period from the date of dissolution of Assembly, till the date of first meeting who has been the speaker of the dissolved Assembly and has continued to be in office as such during the said period."

(d) After the aforesaid proviso the following explanation shall be inserted, namely:-

"Explanation- Where a person has served as a member of the Assembly for the term of six months and above and has not completed one year then such person shall for the purpose of calculating the pension, be deemed to have served as a member for the year."

Section 10. Amendment of Section 2

CHAPTER III

AMENDMENT OF THE UTTAR PRADESH STATE LEGISLATURE (OFFICERS SALARIES AND ALLOWANCES) ACT, 1952

(As applicable in the Uttaranchal)

10. Amendment of Section 2.- In section 2 of the Uttar Pradesh State Legislature (Officers Salaries and Allowances) Act, 1952, hereinafter in this Chapter referred to as the principal Act, in sub-section (1) for the words ‘Two thousand and five hundred rupees’ the words ‘Five thousand rupees’ shall be substituted.

Section 11. Amendment of Section 4

11. Amendment of Section 4.- In section 4 of the principal Act, in sub-section (3) for the words ‘Two thousand and five hundred rupees’ the words ‘Five thousand rupees’ shall be substituted.

Section 12. Amendment of Section 3

Chapter-IV - Amendment of the Uttar Pradesh Ministers (Salaries, Allowances and Miscellaneous Provision) Act, 1981

CHAPTER IV

AMENDMENT OF THE UTTAR PRADESH MINISTERS (SALARIES, ALLOWANCES AND MISCELLANEOUS PROVISION) ACT, 1981

(As applicable in the Uttaranchal)

12. Amendment of Section 3.- In section 3 of the Uttar Pradesh Ministers (Salaries, Allowances and Miscellaneous Provisions) Act, 1981 herein referred to as principal Act-

(a) In sub-section (1) for the words ‘Two thousand five hundred rupees’ the words ‘Five thousand rupees’ shall be substituted;

(b) In sub-section (2) for the words ‘Two thousand two hundred and twenty five rupees’ the words ‘Four thousand rupees’ shall be substituted.

Section 13. Amendment of Section 6

13. Amendment of Section 6.- In section 6 of the principal Act, in sub-section (1) for the words ‘at such rates and upon such conditions as may be prescribed’ the words ‘Five hundred rupees per day, which shall not exceed Fifteen thousand rupees in a month’ shall be substituted.

Chapter-V - Amendment of 3 of the Uttar Pradesh State Legislature (Members Emoluments and Pension) (Uttaranchal Amendment) Act, 2001, Hereinafter Referred as Principal Act

CHAPTER V

AMENDMENT OF 3 OF THE UTTAR PRADESH STATE LEGISLATURE (MEMBERS EMOLUMENTS AND PENSION) (UTTARANCHAL AMENDMENT) ACT, 2001, HEREINAFTER REFERRED AS PRINCIPAL ACT

14. In the sub-section (1) of section 3 of the principal Act-Tor the words ‘Expenses of diesel equivalent to the amount of Railway Coupon for Sixty thousand rupees and the balance Thirty three thousand as Railway Coupon’ the words ‘Expenses of diesel equivalent to the amount of Railway Coupon for Ninety six thousand rupees and the balance Twenty four thousand rupees a Railway Coupon’ shall be substituted."
