This Act may be called the Orissa Aided Educational Institutions (Appointment of Hindi Teachers Validation) Act, 1992.

In this Act, unless the context otherwise requires,

(a) Aided High School means an Aided Educational Institution which is a High School;

(b) Education Act means the Orissa Eduction Act, 1969 (Orissa Act, 15 of 1969);

(c) Selection Board means the Selection Board constituted under the Education Act; and

(d) words and expressions used in this Act but not defined herein shall have the meanings respectively assigned to them in the Education Act or in the Rules and Regulations framed thereunder.

Notwithstanding anything contained in the Education Act or in the Rules of Regulations framed thereunder, Hindi Teachers of Aided High Schools appointed by the respective Managing Committees of such Schools on or rafter the 1st January, 1935 but not later than the 31st December, 1991 without the recommendation of the Selection Board as required under the Education Act, who have completed at least one year of service as such with or without break or breaks having the requisite qualifications and are continuing as such, shall, for all intents and purposes, be deemed to have been validly and regularly appointed, and no such appointment shall be challenged in any court of law merely on the ground that such appointments were made otherwise than in accordance with the procedure bid down in the Education Act and the Rules and Regulations framed thereunder:

Provided that the validation of appointments as aforesaid shall not put persons

(i) appointed as Hindi Teachers of Aided High Schools is during the period between she 1st December, 1976 and the 31st December, 1991 on the recommendation of the Selection Beard; or

(ii) whose appointment as Hindi Teachers in Aided High Schools were validated prior to the commencement of this Act, in a disadvantageous position in any manner whatsoever.
