Himachal Pradesh Essential Services (Maintenance) (Amendment) Act, 1979*

An Act to amend the Himachal Pradesh Essential Services (Maintenance) Act, 1972 (Act No. 5 of 1973).
Be it enacted by the Legislative Assembly of Himachal Pradesh in the Thirtieth Year of the Republic of India as Follows:-
Section 1. Short title and commencement
1. Short title and commencement.- (1) This Act may be called the Himachal Pradesh Essential Services (Maintenance) (Amendment) Act, 1979.
(2) It shall be deemed to have come into force on the 3rd day of March, 1979.
Section 2. Substitution of section 3
2. Substitution of section 3.- For the existing section 3 of the Himachal Pradesh Essential Services (Maintenance) Act, 1972 (5 of 1973) the following section 3 shall be substituted, namely:-
"3. This Act shall apply to,-
(i) any employment or class of employment under the State Government which the State Government may, by notification in the Official Gazette, specify; and
(ii) any other, employment or class of employment which the State Government, being of opinion that such employment or class of employment is essential for securing the public safety, the maintenance of public order, health or sanitation, or for maintaining supplies or services necessary for the life of the community, may, by notification in the Official Gazette, declare to be an employment or class of employment to which this Act applies,",
Section 3. Repeal and savings
3. Repeal and savings.- (1) The Himachal Pradesh Essential Services (Maintenance) (Amendment) Ordinance, 1979 (1 of 1979) is hereby repealed.
(2) Notwithstanding such repeal, anything done or any action taken under the Himachal Pradesh Essential Services (Maintenance) Act, 1972 (5 of 1973), as amended by the said Ordinance, shall be deemed to have been done or taken under that Act, as amended by this Act.
