Gujarat act 018 of 1982 : Gujarat Salaries and Allowances of Speaker of Gujarat Legislative Assembly and Ministers Laws (Amendment) Act, 1982

Section 1. Short title and commencement

1. Short title and commencement.- (1) This Act may be called the Gujarat Salaries and Allowances of Speaker of Gujarat Legislative Assembly and Ministers Laws (Amendment) Act, 1982.

(2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.

Section 2. Insertion of new section 6A and 6B in Guj. II of 1960

2. Insertion of new section 6A and 6B in Guj. II of 1960.- In the Gujarat Legislative Assembly (Speaker and Deputy Speaker) Salaries and Allowances Act, 1960 (hereinafter in section 3 referred to as "the principal Act") after section 6, the following sections shall be inserted, namely:-

"6A. Traveling allowance on assumption, of office by Speaker and on ceasing to be Speaker.- Subject to any rules or orders made in this behalf by the State Government,-

(a) the Speaker shall be entitled to travelling allowance for himself and the members of his family and for the transport of his and his family's effects in respect of the journey to Gandhinagar from his usual place of residence outside Gandhinagar for assuming office;

(b) the Speaker and members of his family shall be entitled to travelling allowance for himself or themselves and for the transport of effects of the Speaker or, as the case may be, his family in respect of the journey from Gandhinagar to his usual place of residence out-side Gandhinagar on the Speaker ceasing to hold his office.

Explanation.-For the purposes of this section the expression "a member of the family" shall have the same meaning as assigned to it in section 7 and the word "family" shall be construed accordingly.

6B. Telephone facilities to Speaker.- (1) The Speaker shall during the term of his office be entitled to have a telephone installed at Government cost at the place of residence at Gandhinagar.

(2) No charge shall fall on the Speaker personally in respect of installation of, initial deposit for, rental charges for maintenance of, and calls made from, the telephone installed under sub-section (1).".

Section 3. Amendment of section 7A of Guj. III of 1960

3. Amendment of section 7A of Guj. III of 1960.- In the principal Act, in section 7A, for the figures "3,000" the figures "10,000" shall be substituted,

Section 4. Insertion of new section 9A and 9B in Guj. VI of 1960

4. Insertion of new section 9A and 9B in Guj. VI of 1960.- In the Gujarat. Ministers' Salaries and Allowances Art., 1960 (Guj. VI of 1960) (hereinafter in section 5 referred to as "the principal Act"), after section 9, the following sections shall be inserted, namely:-

"9A. Subject to any rules or orders made in this behalf by the State Government,-

(a) Traveling allowance on assumption, of office by Ministers and on ceasing to be Ministers.- Minister and a Deputy Minister shall be entitled to travelling allowance for himself and the members of his family and for the transport of his and his family's effects in respect of the journey to Gandhinagar from his usual place of residence outside Gandhinagar for assuming office;

(b) a Minister or Deputy Minister and members of his family shall be entitled to travelling allowance for himself or themselves and for the transport of effects of the Minister, Deputy Minister or, as the case may be, in family in respect of the journey from Gandhinagar to his unusual place of residence outside Gandhinagar on the Minister or the Deputy Minister ceasing to hold his office.

Explanation.-For the purposes of this section the expression "a member of the family" shall have the same meaning as assigned to it in section 10 and the "family" shall be construed accordingly.

9B. (1) Every Minister and Deputy Minister shall during the term of his office be entitled to have a telephone installed at Government cost at the place of residence at Gandhinagar.

(2) No charge shall fall on the Minister and the Deputy Minister personalty in respect of installation of, initial deposit for, rental charges for maintenance of, and calls made from, the telephone installed under sub-section (1)."

Section 5. Amendment of section II of Guj. VI of 1960

5. Amendment of section II of Guj. VI of 1960.- In the principal Act, in section 11, for the figures "10,000" the figures "25,000" shall he substituted.
