Gujarat Agricultural Produce Markets (Amendment and Validation) Act, 1978*

An Act further to amend the Gujarat Agricultural Produce Markets Act, 1963 and to validate certain notifications issued under sub-section (5) of section 6 of that Act.
It is hereby enacted in the Twenty-ninth Year of the Republic of India as follows:-
Section 1. Short title
1. Short title.- This Act may be called the Gujarat Agricultural Produce Markets (Amendment and Validation) Act, 1978.
Section 2. Amendment of section 6 of Guj. 20 of 1961
2. Amendment of section 6 of Guj. 20 of 1961.- In his Gujarat Agricultural Produce Markets Act, 1963 (Guj. 20 of 1964) (hereinafter referred to as "the principal Act"), in section 6-
(1) in sub-section (1), for the words "under this section" the words "under this sub-section" shall be substituted;
(2) in sub-section (5), the following shall be added at the end, namely:-
"A notification under this sub-section shall also be published in Gujarati in a newspaper having circulation in the said area and in such other manner, as may be prescribed.".
Section 3. Validation of certain notifications
3. Validation of certain notifications.- Notwithstanding any judgement, decree or order of any court, no notification issued under sub-section (5) of section 6 of the principal Act before the commencement of this Act shall be deemed to be or ever to have been invalid merely on the ground that such notification was not also published in Gujarati in a newspaper and in other prescribed manner, as required by sub-section (1) of that section and accordingly no exclusion of any area from a market area or inclusion of any area in a market area or exclusion from or addition to the kinds of agricultural produce, any kind of agricultural produce, made before such commencement by such notification shall be deemed to be, or ever to have been, illegal merely on the ground that such notification was not published in Gujarati in a newspaper and in the other prescribed manner, as required by sub-section (1) of section 6 of the principal Act.
Explanation.-For the purpose of this section expressions "agricultural produce" and "market area" shall have the meanings respectively assigned to them in the principal Act.
