An Act to Amend the Code of Criminal procedure, 1973 in its Application to, the State of Orissa

Be it enacted by the Legislature of the State of the Orissa in the Forty-fifth Year of the Republic of India, as follows:-

Section 1. Short title

1. Short title.- This Act may be called the Code of Criminal Procedure (Orison Amendment) Act, 1994.

Section 2. Amendment of Section 25

2. Amendment of Section 25.- Infection 25 of the Code of Criminal Procedure, 1973 (2 of 1974) (hereinafter referred to as the said Code), to sub-section (2), the following proviso shall be inserted namely:-

"Provided that nothing in this sub-section shall he construed, to prohibit the State Government from exercising its control over Assistant. Public Prosecutors through police officers."

Section 3. Amendment of First Schedule

3. Amendment of First Schedule.- In the First Schedule to the said Code, in the entry under column 5 relating to section 354 of the Indian Penal Code, 1860 for the word "Bailable" the word "non-bailable" shall be substituted".
