Andhra Pradesh Advocates' Welfare Fund and the Andhra Pradesh Advocates' Clerks' Welfare Fund (Amendment) Act, 1998*

An Act Further to Amend the Andhra Pradesh Advocates' Welfare Fund Act, 1987 and Andhra Pradesh Advocates' Clerks' Welfare Fund Act, 1992.
Be it enacted by the Legislative Assembly of the State of Andhra Pradesh in the Forty-ninth Year of the Republic of India, as follows:-
Section 1. Short title
1. Short title:- This Act may be called the Andhra Pradesh Advocates' Welfare Fund and the Andhra Pradesh Advocates' Clerks' Welfare Fund (Amendment) Act, 1998.
Section 2. Amendment of section 4
2. Amendment of section 4.- In the Andhra Pradesh Advocates' Welfare Fund Act, 1987 (Act 33 of 1987),-
(1) in section 4, in sub-section (3) to clause (h), the following proviso shall be added, namely:-
"Provided that the Secretary shall be paid such, sum as honorarium from the Advocates' Welfare Fund as the Committee may determine from time to time, for the services rendered by him"
(2) Amendment of section 12-A.-in section 12-A for the expression "value of rupees eight out of which a sum of rupees six shall be credited to the Andhra Pradesh Advocates, "Welfare Fund and rupees two", the expression "value of rupees twelve out of which a sum of rupees nine shall be credited to the Andhra Pradesh Advocates' Welfare Fund and rupees three" shall be substituted
(3) Amendment of section 15.-in sub-section (1) of section 15, for the words "every advocate" the words "Every Advocate below the age of 65 years" shall be substituted.
(4) Insertion of New section 15A.-after section 15, the following section shall be inserted namely:-
15-A. "Retired person is not eligible for membership.- A person retired from the service of Central Government, State Government or from any Corporation incorporated under the provisions of Indian Companies Act, 1956 (Central Act 1 of 1956) and drawing pension and practising as an advocate shall not be admitted to the membership of the Fund.".
(5) Amendment of section 15.-in section 16,-
(i) in sub-section (1) for the words "on cessation of practice", the words "on cessation of practice or suspension of practice" shall be substituted;
(ii) in the marginal title to the said section, after the word "cessation" the words "or suspension" shall be inserted;
(iii) sub-section (5) shall be omitted.
Section 3. Amendment of section 12-A
3. Amendment of section 12-A.- In the Andhra Pradesh Advocates Clerks' Welfare Fund Act, 1992 (Act 13 of 1992), in section 12-A for the expression "value of rupees-eight out of which a sum of rupees two shall be credited to the Andhra Pradesh Advocates' Clerks' Welfare Fund and rupees six shall be credited to the Andhra Pradesh advocates, Welfare Fund", the expression "value of rupees twelve of out of which a sum of rupees three shall be credited to the Andhra Pradesh Advocates' Clerks, Welfare Fund and rupees nine shall be credited to the Andhra Pradesh Advocates' Welfare Fund" shall be substituted.
