The Court is in receipt of a jointly presented refined class definition. The Court hereby approves the class definition as set out below.

The class consists of all North Dakotans or their legal representatives who, on or after December 1, 1989, were or are still, covered by a long term nursing care policy (Forms 520, 521 and/or 522) originally issued during the years 1984 through 1990 by Acceleration Life Insurance Company and later assumed by Commonwealth Life Insurance Company, but excluding from such class the defendants, any and all officers, directors, employees, and agents of the defendants, their affiliates, and/or subsidiaries. The class also includes persons who originally purchased the policy in North Dakota, but no longer live there.

IT IS SO ORDERED.
