For the reasons set forward in the Memorandum Opinion filed contemporaneously herewith:

It is hereby ORDERED that Defendant's Motion for Summary Judgment [Document #23] is DENIED as to Plaintiff's claim of retaliatory discrimination pursuant to 42 U.s.c. § 2000e et seq. Defendant's Motion for Summary Judgment is GRANTED as to Plaintiff's claim of discriminatory denial of his 1999 application for an available vacancy pursuant to 42 U.S. § 2000e et seq. Defendant's Motion for Summary Judgment is also GRANTED as to Plaintiff's claim of wrongful termination and as to Plaintiff's claim for punitive damages.

It is further ORDERED that Plaintiff's Motion to Strike the Supplemental Affidavit of Kenneth Kline [Document # 29] is DENIED AS MOOT.
