State v. Joseph A. Wheat

Supreme Court of Wisconsin
Jul 1, 2026

NO. 2024AP2369-CR STATE V. WHEAT L.C. #2021CM173

July 1, 2026

The Court, by its Commissioners, has entered the following order:

On May 11, 2026, defendant-appellant-petitioner, Joseph A. Wheat, pro se, filed a

motion to extend the time in which to file a petition for review of the court of appeals’

decision of April 8, 2026, which the court of appeals declined to reconsider by an order

issued May 1, 2026. On May 13, 2026, this court issued an order denying the motion for

an extension of time; however, the motion itself was construed as a timely but

nonconforming petition for review. The court directed Wheat to file a statement in

support conforming to the requirements of WIS. STAT. §§ 809.62(2) and (4) by July 13, 2026.

On June 30, 2026, Wheat filed a notice of voluntary dismissal seeking to “withdraw

[his] appeal.” Accordingly,

IT IS ORDERED that the petition for review filed by Wheat on May 11, 2026 is

dismissed, without costs.
