UNITED STATES BANKRUPTCY COURT

FOR THE EASTERN DISTRICT OF MICHIGAN

SOUTHERN DIVISION

In re: Case No. 26-45368 TIFFANY JENNINGS, Chapter 7 Debtor. Judge Thomas J. Tucker _______________________________________/

ORDER REQUIRING THE DEBTOR'S ATTORNEY, JAMES P. FREGO, II, TO PAY $250.00 TO THE CLERK OF THE COURT, AS A SANCTION FOR FILING THIS CASE

On October 8, 2025, in the case of In re Stacey Wofford, Case No. 25-49526, the Court entered an Order entitled "Order Dissolving Show Cause Order, With Conditions" (Docket # 15 in Case No. 25-49526, the "Wofford Order"). The Wofford Order stated, in relevant part:

IT IS FURTHER ORDERED that the Show Cause Order is dissolved with respect to the Debtor's attorney, James P. Frego, II, subject to the following conditions: (1) if in the future such attorney ever again files a bankruptcy case in violation of a bar order of this Court like the one that was violated in this case, he will be sanctioned and ordered to pay to the Clerk of this Court the sum of $250.00[.]

On May 8, 2026, the Debtor Tiffany Jennings, through her attorney James P. Frego, II, filed a voluntary petition for relief under Chapter 7, commencing this case. The filing of voluntary petition was in violation of a bar order entered in a previous case filed by the Debtor (Case No. 15-57204). In that case, on January 6, 2016, the Court entered an Order dismissing that case. (Docket # 18 in Case No. 15-57204, the "Dismissal Order"). The Dismissal Order stated, in relevant part:

Debtor Tiffany Sharron Jennings is permanently barred from filing a new case until the filing fees are paid.

(Id.) To date, the Debtor has not paid the overdue filing fees for Case Nos. 15-57204 or 15-56062. Despite this, on May 8, 2026, the Debtor, through her attorney, James P. Frego, II, filed a voluntary petition for relief under Chapter 7, commencing this new case. Because the Debtor had not first paid the overdue filing fees for Case Nos. 15-57204 and 15-56062, the

Debtor's filing of this case was in violation of the bar in the Dismissal Order, and today the Court has dismissed this case. For these reasons, and based on the Wofford Order,

IT IS ORDERED that the Debtor's attorney, James P. Frego, II, must pay a sanction of $250.00 to the Clerk of this Court, and must file proof of such payment, all no later than May 22,

2026.
