UNITED STATES BANKRUPTCY COURT EASTERN DISTRICT OF MICHIGAN

SOUTHERN DIVISION

In re: Case No. 26-45212

JASON ROULEAU, SR., Chapter 7

Debtor. Judge Thomas J. Tucker

______________________________________/

ORDER DISMISSING CASE

On May 5, 2026, a document entitled “Bankruptcy Petition Cover Sheet” was filed by an

attorney for Jason Rouleau, Sr., at Docket # 1. The filing attorney caused the docket entry for

this document to state that it was a bankruptcy petition. But that docket entry is inaccurate: no

bankruptcy petition was actually filed under that docket entry, and to date no bankruptcy petition

has been filed. Because no voluntary petition was filed, no bankruptcy case was commenced.

The only way to commence a voluntary case under Chapter 7 is to file a voluntary

petition. See 11 U.S.C. § 301(a) (“A voluntary case under a chapter of this title is commenced by

the filing with the bankruptcy court of a petition under such chapter by an entity that may be a

debtor under such chapter.”); Fed. R. Bankr. P. 1002(a) (“A bankruptcy case is commenced by

filing a petition with the clerk.); see also In re Nettles, No. 23-01108-SWD, 2023 WL 3829172,

at *1 (Bankr. W.D. Mich. June 5, 2023) (“[W]ithout a signed petition, there is no bankruptcy

case, no bankruptcy estate, no automatic stay.”). For these reasons,

IT IS ORDERED that this case is dismissed.
