Clerk

December 30, 2025 169265 & (17) PEOPLE OF THE STATE OF MICHIGAN,

Plaintiff-Appellee, v SC: 169265 COA: 377105

Oscoda CC: 2023-001884-FC ROBERT ALLEN DECLERCQ,

Defendant-Appellant. _________________________________________/ On order of the Court, the motion for immediate consideration is GRANTED. The application for leave to appeal the November 4, 2025 order of the Court of Appeals is considered. We DENY leave to appeal the Court of Appeals’ order denying the motion to compel. This order is without prejudice to the defendant’s ability to file another motion with the Court of Appeals panel to which this case is ultimately assigned. And it is without prejudice to the Court of Appeals panel granting that relief if it determines it is necessary to adequately address the issues raised on appeal. WELCH and THOMAS, JJ., would grant leave to appeal.
