SUTTON (KEVIN) v. WARDEN (CRIMINAL)

Supreme Court of Nevada
Dec 3, 2025

IN THE SUPREME COURT OF THE STATE OF NEVADA

KEVIN D. SUTTON,

Appellant,

vs.

WARDEN, RENE BAKER,

Respondent.

No. 91535

FILED

DEC 0 3 2025

SUPREME COURT

OF

NEVADA

OH 1947A 09

ORDER DISMISSING APPEAF

This is a pro se notice of appeal from a district court order purportedly denying an "Application for Writ of Habeas Corpus." Eighth Judicial District Court, Clark County; Carli Lynn Kierny, Judge. This court's review of this appeal reveals a jurisdictional defect. Specifically, the appeal appears premature because no appealable order has been entered in the district court proceedings, and the proceedings on appellant's August 2025 postconviction petition for a writ of habeas corpus appear to be ongoing in the Eighth Judicial District Court. Appellant may appeal from a final judgment resolving all of his postconviction claims, if aggrieved. See NRS 34.575. Thus, the notice of appeal is premature, and this court

ORDERS this appeal DISMISSED. Pickering
