Case No. 2024-05186 -2- Motion Nos. 2025-04390 2025-04698
Respondents-respondents having moved for leave to appeal to the Court of Appeals from the decision and order of this Court, entered on July 10, 2025 (Appeal No. 3780), (Motion No. 2025-04390),
And petitioners-appellants having cross moved, pursuant to CPLR §5519(c), to vacate the automatic stay of proceedings to enforce the order on appeal (Moton No. 2025-04698),
Now, upon reading and filing the papers with respect to the motion and cross motion, and due deliberation having been had thereon,
It is ordered that respondents-respondents' motion is granted, and this Court, pursuant to CPLR 5713, certifies that the following question of law, decisive of the correctness of its determination, has arisen, which in its opinion ought to be reviewed by the Court of Appeals:
Was the order of this Court, which found that the City Council was not preempted from legislating in the field of rental assistance, properly made?
This Court further certifies that its determination was made as a matter of law and not in the exercise of discretion (Motion No. 2025-04390),
And, it is further ordered that petitioners-appellants' cross motion is denied (Motion No. 2025-04698).
