KEREN WILLIAMS
ORDER
On May 27, 2025, the Respondent filed with the Board a Combined Motion to Dismiss or
for Summary Judgment. Because the Board currently lacks a quorum, the Motion has been
referred to me pursuant to Section 102.179 of the Board’s Rules and Regulations.
The Respondent’s Combined Motion to Dismiss or for Summary Judgment is denied.
The Respondent has not demonstrated that the consolidated complaints fail to state a claim upon
which relief can be granted and that it is entitled to judgment as a matter of law.1 This denial is
without prejudice to the Respondent’s right to renew its arguments before the Administrative
Law Judge at hearing or, if necessary, to the Board on exceptions.
Dated, Washington, D.C., June 23, 2025
Robert A. Giannasi
Chief Administrative Law Judge
1 I have disregarded all references to the extra-record evidence referenced in the Respondent’s
motion. See, e.g., Fund for the Public Interest, 360 NLRB 877, 877 fn.2 (2014). I therefore find it unnecessary to pass on the Acting General Counsel’s motion to strike the extra-record
evidence.
