         ORDER MODIFYING OPINION

         Kane, J.

         It is ordered that the opinion filed herein on July 22, 2009, be modified as follows:

         The disposition on page 16 is deleted and the following inserted:

         DISPOSITION

         The judgment against BFMC is reversed. The trial court is directed to enter a new judgment in favor of BFMC. Costs on appeal are awarded to BFMC.

         This modification changes the judgment.
