ORDER

This matter is before the court on the parties' Stipulation to Dismiss.

The parties stipulate that this appeal be dismissed with prejudice pursuant to Federal Rule of Appellate Procedure 42(b), with each party to bear its own costs and attorney's fees incurred on appeal.

Upon consideration, the stipulation for voluntary dismissal is granted and this appeal is dismissed with prejudice. See Fed. R. App. P. 42(b); 10th Cir. R. 27.5(A)(9). Each party will bear its own costs and fees.

A copy of this order shall stand as and for the mandate of the court.
