Folsom v. Warren

United States Court of Appeals, Tenth Circuit
Feb 1, 2022

(D.C. No. 5:21-CV-00952-D) (W.D. Okla.)

ORDER

On January 14, 2022, this court entered an order directing Plaintiff Glen Folsom to address the basis for appellate jurisdiction over the district court's December 10, 2021 order directing partial fee payment that does not appear to be final and appealable.

The district court docket shows that the magistrate judge entered a report and recommendation on January 28, 2022 recommending dismissal for failure to pay the initial filing fee. However, the district court has not yet entered a final decision with respect to the report and recommendation or otherwise entered final judgment.

Mr. Folsom's response, that he has captioned for multiple appeals, does not address this court's January 14, 2022 show cause order with respect to jurisdiction for this appeal. 1

Accordingly, this appeal is dismissed for failure to file a timely response that specifically addresses the basis for jurisdiction over this appeal. See 10th Cir. 42.1.

The dismissal of this appeal will not bar Mr. Folsom from filing a new appeal in accordance with all applicable procedural rules and time limitations once a final decision has been entered by the district court.

A copy of this order shall stand as and for the mandate of this court. 2
