Carosone v. Carosone
BACKES, Advisory Master.
Carl Abruzzese, of Newark, for petitioner.
This is an ex parte suit for divorce. Application is made for an order of publication. Petitioner alleges desertion to have commenced on October 28, 1921; also that the last act of extreme cruelty was committed on March 14, 1922, and that more than six months have elapsed since the date of the last act of cruelty complained of. The cause of action arose in the first instance two years later, and in the latter six months later. She further alleges that she was a bona fide resident of this state when this cause of action arose, and has ever since continued to be a bona fide resident down to the time of the commencement of the action, but she does not allege that she has been a bona fide resident of the state for two years next preceding the commencement of the action. Section 6 (a) of the Divorce Act of 1907 (2 Comp. St. 1910, p. 2030) provides "that no action for absolute divorce shall be commenced for any cause other than adultery, unless one of the parties has been for the two years next preceding the commencement of the action a bona fide resident of this state."
