State v. Parker
Court of Appeals of Kansas.
Aug 1, 2014
PER CURIAM.
Judges are not functionaries, and their discretion should not be exercised as rote. The fugitive disentitlement doctrine serves a purpose and can be engaged appropriately in many situations. The circumstances before us, however, define an atypical situation so far as the doctrine is concerned. The discernment that must center judicial discretion in the face of the atypical requires that Parker be permitted to argue her constitutional cause to this court.
