Liquor law — Seizure of vehicle engaged in transportation of liquor — Conditional sale — Owner — Automobile — Knowledge of seller — Act of March 27, 1923, P. L. 34.

The seller of an automobile under a conditional sales contract is not entitled, under the Act of March 27, 1923, P. L. 34, to a return of the automobile which had been seized as forfeited to the Commonwealth while being used in the unlawful transportation of intoxicating liquors, although there is proof that such unlawful use was without the knowledge and consent of the seller.

Argued May 11, 1931.

PER CURIAM, May 25, 1931:

The judgment in this case is affirmed on the opinion of the Superior Court. Costs to be paid by appellant.
