BROWN v. ALEXANDER AND ALLISON

Superior Court for Law and Equity, Washington District.
Sep 1, 1808

Where a record has been lost, as, for example, a prison bounds bond, the Court will receive evidence of the loss, and of the contents, the substance of which will be recorded; and upon such record proceed as upon the original. [See Code, 3907; 2 Cold. 319; 3 Cold. 12, 277; 4 Cold. 397.]

A bond was given for the prison bounds in Greene county, and a return by the sheriff showing the taking of the bond upon the ca. sa. Notice had been given under the Act of 1759, c. 14, Ird. 189, that judgment would be moved for. The bond was lost.
