RUSCH v. JOHNSON
Appellate Court of Illinois, First District.
Jan 20, 1941
ELECTIONS, § 243 — contempt, trial judge candidate at election involved. In contempt proceedings against election officials for assisting voters not entitled to assistance, and without requiring voters to make an affidavit, conviction would be reversed where trial judge was a candidate at the election in question, and since no one was permitted to vote who was not entitled to, and the court was admittedly correct, if defendants should be found guilty upon retrial a moderate fine would be sufficient punishment.
See Callaghan's Illinois Digest, same topic and section number.
Opinion by PRESIDING JUSTICE O'CONNOR.
"Not to be published in full." Opinion filed January 20, 1941; rehearing denied February 5, 1941.
