PAGANO v. ARNSTEIN

In an action to revive a mortgage, to have the plaintiff declared the owner thereof and to foreclose the mortgage, order granting defendant's motion to dismiss the complaint on the ground that there is an existing final judgment of a court of competent jurisdiction, rendered on the merits, determining the same cause of action between the parties, and the judgment entered thereon, unanimously affirmed, with ten dollars costs and disbursements. No opinion.
