QUINTANA v. AMERICAN EXPORT LINES, INC

Appellate Division of the Supreme Court of New York, Second Department.
Nov 5, 1951

Appeal by plaintiff from an order of the Calendar Classification and Control Term directing that the action be marked off the General Calendar, placed on the Deferred Calendar, and that the action shall not be transferred to the Day Reserve Calendar before October 19, 1955, five years from the date of the order. Order modified on the facts by striking the figure "1955" from the ordering paragraph and substituting therefor the figure "1953". As so modified, the order is affirmed, without costs. In our opinion, the action should not have been deferred for more than three years. Carswell, Acting P.J., Johnston, Adel, Wenzel and MacCrate, JJ., concur.
