FELICE v. KARABAG
Appellate Division of the Supreme Court of New York, Second Department.
Apr 17, 1995
Ordered that the judgment is affirmed insofar as appealed from; and it is further,
Ordered that the defendants are awarded one bill of costs.
Under the circumstances, the plaintiff's complaint against the defendant Carolyn Mulderig was properly dismissed. In addition, the jury's apportionment of fault between the plaintiff's decedent and the defendant Ejder Karabag was not against the weight of the evidence (see, Nicastro v Park, 113 A.D.2d 129, 134).
We have considered the plaintiff's remaining contentions and find that they do not require reversal. Ritter, J.P., Altman, Hart and Goldstein, JJ., concur.
