DUFFY v. CALCAGNI
Appeals Court of Massachusetts.
Oct 2, 1996
The judgment of dismissal because of the plaintiff's failure to file a bond is reversed. The report of the medical malpractice tribunal is vacated and there shall be substituted therefor as to all defendants a finding that upon the offer of proof presented, the evidence, if properly substantiated, is sufficient to raise a legitimate question of liability appropriate for judicial inquiry. The case is then to stand for trial.
