Upon consideration of the appellant's Motion for Rehearing or Clarification and Motion for Rehearing En Banc and appellee's Motion for Clarification, it is

ORDERED that the Motions for Clarification are granted to the extent that the opinion filed December 2, 1998, is withdrawn, and the attached opinion is substituted for that opinion.

The motions are denied in all other respects.
