NATIONSBANK v. RANEY, (W.D.Va. 1999)

United States District Court, W.D. Virginia, Harrisonburg Division
Dec 1, 1999
ORDER

Jackson L. Kiser Senior United States District Judge

Before me now are requests for guardian ad litem fees by Daniel J. Meador, Jr., and Neal L. Walters. Mr. Meador has served as guardian ad litem for A. Edward Raney, a defendant, while Mr. Walters has served as guardian ad litem for Dagney and Arlin Raney, the minor beneficiaries of the Raney Family Trust. In response to these requests, Linda F. Raney, whom I declared in my November 1 Order and Memorandum Opinion the rightful recipient of the interpleader fund as trustee of the Raney Family Trust, indicated that she has no objection to the amounts requested by the two guardians ad litem. Therefore, I hereby GRANT the motions by both guardians ad litem and ORDER the clerk to distribute the following amounts from the interpleader fund:

(1) $15,896.49 to Mr. Meador for his services as A. Edward Raney's guardian ad litem;
(2) $2,618.09 to Mr. Walters for his services as the minor children's guardian ad litem; and
(3) the remaining amount to Linda F. Raney as Trustee of the Raney Family Trust, which is pursuant to my November 1, 1999, Order and Memorandum Opinion.

After distributing the interpleader fund as explained above, the clerk is directed to REMAND the remaining claims to the Circuit Court of Fairfax County, Virginia. The clerk is directed to send a certified copy of this Order to all counsel of record.
