THIS MATTER having come before the Court on the motions of defendants Sonic Financial Corp.'s ("Sonic") and Speedway Motorsports, Inc.'s ("Speedway") for summary judgment;

The Court having reviewed the record and the submissions of the parties; and

For the reasons stated in the Court's opinion of this date;

IT IS on this 22nd day of February, 2000, HEREBY ORDERED that Sonic's motion is GRANTED; and

IT IS FURTHER ORDERED that Speedway's motion is GRANTED.

No costs.
