This Proceeding is before the Court on the Complaint Objecting to Discharge and/or to Except Debt from Discharge filed by Shapell's Inc. on September 30, 1999. In accordance with Findings of Fact and Conclusions of Law separately entered and statements made orally on the record, it is ORDERED and ADJUDGED:

1. Any debt owed by Defendant, Brian G. Perry, to Plaintiff, Shapell's, Inc., is not excepted from discharge under 11 U.S.C. § 523.

2. Defendant, Brian G. Perry, is denied a discharge pursuant to 11 U.S.C. § 727.
