PRINCE v. DICKER, (E.D.N.Y. 2001)

United States District Court, E.D. New York.
Feb 20, 2001
MEMORANDUM AND ORDER

NICKERSON, District Judge:

Pro se plaintiff Emanuel Prince brought this action against the owner and various employees of Shore View Nursing Home ("Shore View"), where his sister resided from 1990 until her death in 1998. He claims that Shore View and its employees violated federal law, primarily section 1961 of the Racketeer Influenced and Corrupt Organizations Act, § 18 U.S.C. § 1961-1968, et seq., by engaging in, among other things, extortion, mail fraud, wire fraud, obstruction of justice, stalking and the sexual exploitation of children.

All of the defendants move to dismiss the complaint pursuant to Rule 8 and Rule 12(b)(6) of the Federal Rules of Civil Procedure and to strike from the complaint any redundant, immaterial, impertinent, and scandalous matter pursuant to Rule 12(f). Alternatively, the defendants move for a more definite statement pursuant to Rule 12(e).

In its current state plaintiff's complaint is unintelligible and the court is unable to adjudicate any claims therein. But the court declines to dismiss this pro se plaintiff's action at this time.

The court hereby refers this matter to Magistrate Judge Joan M. Azrack to hear and report.

So ordered.
