MANDEL v. JOHNSON
Appellate Division of the Supreme Court of New York, Second Department.
Jul 30, 2001
ORDERED that the order is affirmed, with costs.
The Supreme Court properly denied the plaintiff's motion to restore the action to the trial calendar, since he failed to demonstrate a reasonable excuse for his delay (see, CPLR 3404; Furniture Village v. Schoenberger, A.D.2d [2d Dept., May 29, 2001]; Lopez v. Imperial Delivery Serv., A.D.2d [2d Dept., May 14, 2001]).
SANTUCCI, J.P., ALTMAN, LUCIANO and H. MILLER, JJ., concur.
