ORDER ALLOWING AND AUTHORIZING PAYMENT OF ATTORNEYS' FEES AND EXPENSES UNDER THE AMENDED INTERIM ORDER PARAGRAPH 22, FILED BY MERCURY AIR GROUP, INC. AND RPA AIRLINE AUTOMATION SERVICES INC.
LINDA B. RIEGLE, United States Bankruptcy Judge
At Las Vegas, in said District, on August 28, 2001, came on for hearing the Second Motion for Allowance and Payment of Attorneys' Fees and Expenses Under the Amended Interim Order, Paragraph 22, filed by Mercury Air Group, Inc. ("Mercury") and RPA Airline Automation Services, Inc. ("RPA") (the "Motion"); and it appearing to the Court that the Motion sought allowance and payment of a total of $78,819.11 for Verner, Liipfert, Bernhard, McPherson and Hand, Chartered ("Verner, Liipfert"), comprised of $70,651.50 in fees and $8,167.61 in expenses and a total of $17,916.82 for Hale Lane Peek Dennison Howard and Anderson ("Hale Lane"), comprised of $14,991.50 in fees and $2,925,32 in expenses for the period February 1, 2001 through May 31, 2001; and it appearing to the Court that the fees and expenses were incurred by movants under the Amended Interim Order in connection with providing postpetition financing to National Airlines, Inc. (the "Debtor"); and it appearing to the Court that notice of the hearing on the Motion was appropriate, adequate and sufficient under the Bankruptcy Rules of Procedure and the local rules of this district; and it appearing to the Court that no objections to the Motion were filed; and after considering the Motion, the evidence adduced, and the arguments of the parties and the voluntary reduction of fees by Verner, Liipfert in the amount of $2,340.50, the Court hereby finds that the relief requested in the Motion is appropriate. Accordingly, it is hereby:
The Motion inadvertently used $1,925.32, instead of $2,925.32. The backup to the Motion evidences Hale Lane indeed incurred $2,925.32 in out of pocket expenses during this period.
ORDERED, ADJUDGED and DECREED that Mercury and RPA be and hereby are allowed Chapter 11 administrative expenses for attorneys' fees and expenses in the amount of $94,395.43, comprising of Verner, Liipfert's fees of $68,311.00 and $8,167.61 in out of pocket expenses and Hale Lane's fees of $14,991.50 and $2,925.32 in out of pocket expenses; and it is further
ORDERED, ADJUDGED and DECREED that the Debtor pay Mercury $94,395.43, as long as the payment of such amount will not endanger the ability of the Debtor to continue its operation in Chapter 11.
