Based upon the Court's Findings of Fact and Conclusions of Law as recited in the attached Order, Conseco Finance Servicing Corporation's ("Conseco") Motion for Relief from Judgment or Order ("Motion") pursuant to Federal Rule 60 (b) of Civil Procedure, applicable to bankruptcy proceedings by Federal Rule 9024 of Bankruptcy Procedure, is granted and the Confirmation Order of September 19, 2001 is vacated as it relates to Conseco. Upon a motion to value or objection to Conseco's claim filed by Willie L. Johnson ("Debtor") within ten days of this Order, the Court will schedule a valuation hearing or hearing on Debtor's objection to Conseco's claim.
