ORDER ON PLAINTIFF'S MOTION FOR INTERIM RELIEF AND ON PLAINTIFF'S MOTION FOR SUMMARY JUDGMENT

For the reasons set forth in the separate memorandum of decision issued today,

1. the Motion of Executive Risk Indemnity, Inc., for Summary Judgment is hereby DENIED and

2. the Motion of Executive Risk Indemnity, Inc. ("ERI") to Authorize Interim Payment of Expert Costs is hereby ALLOWED as follows: ERI is granted relief from any applicable stay or injunction to make disbursements for expert costs not to exceed $600,000.
