This matter having appeared before the Court upon the parties' cross-motions for summary judgment, the Court having considered the submissions of the parties and having heard oral argument, for the reasons stated in an opinion issued by the Court, which findings of fact and conclusions of law are incorporated herein by reference,
And for good cause shown,IT IS on this 25th day of July, 2002, ORDERED THAT:
1) The Motion for Summary Judgment of Defendant Delaware River Port Authority is GRANTED; and
2) The Motion for Partial Summary Judgment of Plaintiffs Avtar Heir and HG Petroleum Corp. is DENIED.
