ARTICHOKE JOE'S v. NORTON, (E.D.Cal. 2002)

United States District Court, E.D. California.
Aug 5, 2002
ORDER

DAVID F. LEVI, United States District Judge

The following corrections and additions shall be made to the Memorandum of Opinion and Order filed July 29, 2002: Page 13, line 4: "intertribal gaming" deleted; Page 16, line 13: Page 5, line 16 and footnote 54 "Grover" corrected to "Gover";

Page 20, line 1: a new footnote 21 is inserted as follows: "Gale Norton became Secretary of the Interior on January 31, 2001. The compacts at issue were approved by her predecessor, Bruce Babbitt. Because Secretary Norton does not suggest that there has been any change in agency policy and for ease of expression, all actions by Secretary Babbitt are treated as actions by Secretary Norton throughout this opinion.";

Page 25, line 2: "III." should be "II." Subsequent numbering is changed accordingly;

Page 41, line 26: "Governor" should be "Attorney General";

Page 75, line 17: "class II" should be "class III";

Page 79, footnote line 23: "Fon" should be "Fond";

Page 92, line 8: "overruled" should be "rev'd";

Page 94, line 18: Insert "In short,";

Page 94, line 19: "provisions" should be "provision".

An amended opinion is attached incorporating the above corrections. No new judgment shall enter, because the corrections are not substantive and an appeal has not yet been docketed by the Court of Appeals.

IT IS SO ORDERED.
