IT IS HEREBY ORDERED that Defendant s motion for summary judgment (#14) be and is GRANTED and Plaintiff's motion for summary judgment (#15) be and is DENIED. Judgment is entered for Defendant and against Plaintiffs on the merits of the Plaintiffs complaint.

IT IS FINALLY ORDERED that this cause of action is DISMISSED and removed from the Court's trial docket of September 30, 2002.
