THIS MATTER comes before the Court on Defendant Nadeem Malik's Motion to Dismiss Count IV of the Superseding Indictment, filed September 11, 2002 (Doc. 102). Due to the lack of case law interpreting 8 U.S.C. § 1325(c), this Court finds Defendant's motion well taken, and it is, therefore, granted.

IT IS ORDERED that Defendant Nadeem Malik's Motion to Dismiss Count IV of the Superseding Indictment, filed September 11, 2002 (Doc. 102) is GRANTED.
