This matter is before the Court on the Report and Recommendation of the Magistrate Judge filed October 18, 2002. Neither party has objected to the Magistrate's findings of fact or conclusions of law. Having considered the matter, and deeming it proper and just to do so, it is hereby ORDERED that

(1) The Report and Recommendation of the Magistrate Judge is ACCEPTED and ADOPTED;

(2) Plaintiff's Motion for Summary Judgment is GRANTED;

(3) Defendant's Motion for Summary Judgment is DENIED;

(4) the decision of the Commissioner is REVERSED and this case is REMANDED to the Commissioner for a calculation and payment of benefits.

Let the Clerk send a copy of this order to all counsel of record.

It is so ORDERED.
