IT IS ORDERED that the defendant's motion to stay ruling on summary judgment and to continue case [Doc. #85] is granted in part and denied in part.

IT IS FURTHER ORDERED that the February 3, 2003 trial setting is vacated. The Court will establish a new trial date after disposition of the pending appeal in Monsanto Company v. McFarling, No. 4:00-CV-84 (CDP).
