Pursuant to the court's Memorandum and Order previously filed this date, the order that was entered by the United States Bankruptcy Court for the District of Nebraska on September 13, 2002 (bankruptcy court filing 43), is reversed, and the case (adversary proceeding AO 1-402 8) is hereby remanded to the bankruptcy court with directions to dismiss Plaintiffs complaint without prejudice.
