The court has before it Plaintiff's Motion to Modify Protective Order and For Other Relief (Doc. 95). The court hereby DENIES Plaintiff's Motion to Modify for the reasons stated in the memorandum opinion filed simultaneously with this Order.

The parties have advised the court that they have settled all other issues. Therefore, the court dismisses this case without prejudice to reinstatement if any party represents to the court by 4:30 p.m. on or before September 23, 2003 that final settlement documentation could not be completed.
