For the reasons stated in the accompanying memorandum opinion, IT IS on this 29^th day of August, 2003 ORDERED that defendants' motion to. dismiss pursuant to Federal Rule of Civil Procedure 12(b)(6) (no. 8-1 on the docket) be and hereby is GRANTED; and

IT IS FURTHER ORDERED that plaintiffs' cross motion for partial summary judgment pursuant to Federal Rule of Civil Procedure 56 (c) (no. 16-1 on the docket) be and hereby is DENIED AS MOOT; and

IT IS FURTHER ORDERED that the complaint be and hereby is DISMISSED in its entirety; and

IT IS FURTHER ORDERED that the Clerk of the Court may designate this action as CLOSED.
