For the reasons set forth in the memorandum opinion filed contemporaneously herewith,

IT IS ORDERED that Defendants' motion to dismiss [Doc. #5] for failure to state a claim is GRANTED and all claims are DISMISSED except the North Carolina civil conspiracy claim against Defendants Town of Chapel Hill, Jarvies, Riddle, and Matthews.

IT IS FURTHER ORDERED that the North Carolina civil conspiracy claim against Town of Chapel Hill, Jarvies, Riddle, and Matthews is REMANDED to the General Court of Justice, Superior Court Division, Durham County, North Carolina.
