IT IS HEREBY ORDERED, ADJUDGED and DECREED that defendant shall have summary judgment against plaintiff, that plaintiff shall take nothing on his complaint, and his complaint is DISMISSED with prejudice.

Plaintiff shall bear any taxable costs of this action.
