THIS MATTER is before the Court on Defendant BBT's Motion to Dismiss Plaintiff's Second Claim for Relief of the Complaint pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure. For the reasons set forth in the accompanying memorandum opinion, the Court hereby DENIES Defendant BBT's Motion to Dismiss.
