On January 8, 2004, the creditor, Citibank N.A., filed a Motion for Relief From Stay. On January 9, 2004, an Order was entered by this Court granting Debtors a discharge. Pursuant to 11 U.S.C. § 362(c)(2)(C), an automatic stay terminates when a discharge is granted. Therefore, because in this instance the stay is no longer in effect the creditor's motion is moot. Accordingly, the hearing is vacated on the creditor's motion scheduled for February 6, 2004 at 9:30 a.m.
